- News and program emails need a member’s express consent before you send them.
- The three-year transition that allowed implied consent for existing members ended in 2017.
- Your club is responsible for complying with the law and for what its emails say.
Canada’s Anti-Spam Legislation (CASL) applies even when your club emails its own members. Club 1.0’s email tool helps by making you pick a season and one of three mailing lists before every send.
The three mailing lists
- Transaction & Service Notifications — invoices, waitlist notices and factual messages about something a member bought, such as a class being rescheduled or moved. Members can’t opt out; these messages are exempt under section 6(6)(b) and (d) of the Act.
- Member Information Messages — factual news about a member’s ongoing membership, such as an AGM notice or a membership expiry. Members can opt out, and the option is on by default for new accounts. Exempt under section 6(6)(d)(ii), as long as the message is only factual.
- News, Upcoming Program & Registration Information — club news, upcoming events and registration dates. Not exempt: members must opt in first.
How members give consent
Since July 1, 2014, new members choose at sign-up whether to receive the news list. That opt-in is your record of express consent.
Who can send messages members can’t opt out of
Only admins in a permission group with Can Send Non Opt Out Messages can send to the Transaction & Service Notifications list. Add it to each group that needs it, Full Admin Access included, and check that each such message really is transactional.
